DMCA Policy

1. Overview

Semina is a hosting provider. We provide managed seedbox infrastructure and do not monitor, control, or inspect the content stored on or transferred through our users' seedboxes. However, we respect intellectual property rights and respond to valid DMCA takedown notices in accordance with the Digital Millennium Copyright Act.

2. Submitting a Takedown Notice

If you believe that content hosted on Semina infringes your copyright, please send a written notice to dmca@semina.app that includes:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, with enough detail for us to locate it
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner
  • Your physical or electronic signature

3. Our Process

When we receive a valid DMCA notice:

  1. We forward the notice to the account holder associated with the identified content
  2. The account holder has 48 hours to remove the infringing material
  3. If the material is not removed within 48 hours, we may disable access to it

4. Counter-Notice

If you believe your content was removed by mistake or misidentification, you may file a counter-notice with us. A valid counter-notice must include:

  • Your name, address, and phone number
  • Identification of the material that was removed
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  • Consent to the jurisdiction of the courts in your district
  • Your physical or electronic signature

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the content.

5. Three-Strike Policy

We take repeat infringement seriously. Our policy is as follows:

  • First strike — You receive a warning. The infringing content must be removed within 48 hours.
  • Second strike — Your account is suspended for 7 days. The infringing content is removed by us.
  • Third strike — Your account is permanently terminated and all data is deleted.

Strikes are cumulative over the lifetime of your account.

6. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate the accounts of users who are repeat infringers in appropriate circumstances. We apply this policy consistently and fairly.
